Facts
Kleenco Corp. (defendant) rented a truck from United Truck Rental Equipment Leasing, Inc. (plaintiff). The truck was stolen when a Kleenco employee left the keys in the truck’s ignition. United sued Kleenco, and the court awarded United the retail value of the truck plus loss-of-use damages for the rentals it lost by not having the truck in its possession. Kleenco appealed, arguing that United had bought the truck in bulk and gotten it for the wholesale price and that United had not shown any lost net profits due to the loss of the truck.
