Facts
In the six years prior to Susan Woods’s death, her son, John Woods (plaintiff), cared for her and managed her assets. John was in Susan’s will and upon her death received one-half of Susan’s estate. John sued the executor of Susan’s will (defendant), seeking to recover additional compensation for his service to Susan. Witnesses stated that they heard Susan say multiple times that John would be paid for his services to her. The trial court directed a verdict in favor of the executor. John appealed.
