Although the Due Process Clause applies to actions taken by administrative agencies, the amount of process that’s due is generally less than that required in a civil or criminal trial. In all cases, there are three minimum requirements for due process: first, notice; second, an opportunity to be heard; and third, a neutral decisionmaker. The amount of additional due process that the law requires is governed by a balancing test.
