This lesson will discuss how to measure compensatory damages when a defendant breaches a contract. The amount of damages depends on which of three interests the plaintiff’s seeking compensation for, the expectancy or expectation interest, the reliance interest, or the restitutionary interest. With rare exceptions, a plaintiff may recover damages based on only one of the three, whichever’s highest.
