Facts
John Andrews (plaintiff) and Cynthia Mae Andrews (defendant) were married. During the marriage, John managed the couple’s community property and made several poor investments with community funds that led to a loss of community assets. Cynthia Mae was aware of some of these investments and, in some cases, helped write the checks each month. Upon divorce, the trial court unequally divided the remaining community property in favor of Cynthia Mae due to John’s waste and mismanagement of community funds. John appealed.
