Black & Decker, Inc. (B&D) (plaintiff) owned a design patent for its Dustbuster handheld vacuum cleaner. It filed a complaint against North American Phillips Corp. (Norelco) (defendant) for, among other things, design-patent infringement and trade-dress infringement, identifying the Norelco Clean Up Machine as the accused product for both claims. Norelco moved for partial summary judgment of noninfringement as to both claims, arguing that dissimilarities between the respective designs negated liability.
