Facts
The city of Everett (the city) (plaintiff) sought to develop a solid-waste-disposal facility on a site located in the county of Snohomish (the county) (defendant). However, the city’s proposed use of the site was prohibited by the county’s zoning ordinance. The city brought suit, contending that it had the authority to develop the facility on the site. The superior court granted summary judgment in favor of the city. The county appealed.
