Facts
The National Labor Relations Board (NLRB) (defendant) ordered Golden State Bottling Co., Inc. (plaintiff) to reinstate with backpay one of its employees after finding Golden State engaged in unfair labor practices. A short time later, All American Beverages, Inc., bought Golden State and continued its business. The NLRB ordered that All American reinstate the employee and that either All American or Golden State give the employee the ordered backpay. Golden State appealed, and the court of appeals enforced the order. Golden State appealed to the United States Supreme Court, which granted certiorari.
