Facts
Planned Parenthood Association of San Mateo County (Planned Parenthood) (plaintiff) obtained a permanent injunction against Operation Rescue of California (ORC) and Robert Cochran in 1995. The injunction applied to ORC, Cochran, all persons acting in concert with them, and all persons with actual notice of the injunction. The injunction prohibited several actions related to protesting around Planned Parenthood’s clinic, including demonstrating, picketing, distributing literature, or counseling on the clinic property or within 15 feet of the property. In 2001, Planned Parenthood sought a declaration that the injunction applied to Rossi Foti and Jeannette and Louie Garibaldi (defendants). Planned Parenthood moved for summary judgment, and the trial court granted the motion. Foti and the Garibaldis appealed to the California Court of Appeals.
