Mission Product Holdings, Inc. v. Tempnology, LLC

139 S.Ct. 1652 (2019)
Tempnology, LLC (debtor) made athletic apparel under the brand name “Coolcore” with trademarked logos and labels. Tempnology licensed Mission Product Holdings, Inc. (Mission) to distribute Coolcore products in the United States and use Coolcore trademarks around the world. Tempnology filed for reorganization a year before the licensing agreement expired and rejected the contract. The bankruptcy court approved the rejection and concluded it terminated Mission’s right to use Coolcore trademarks. Mission appealed, and the bankruptcy appellate panel reversed. The First Circuit reversed and reinstated the bankruptcy court’s decision. The Supreme Court granted review.
