Facts
Strike 3 Holdings, LLC (Plaintiff) owned the rights to particular adult entertainment films. Strike 3 alleged that John Doe (defendant) had been illegally downloading and distributing the films. Strike 3 claimed that it was able to trace Doe’s IP address to a physical address. Strike 3 stated that Doe’s internet-service provider was the only entity that could identify Doe by correlating the IP address linked to the alleged infringement with an individual’s identity. Strike 3 moved for leave to file a subpoena on Doe’s internet-service provider to learn Doe’s identity, investigate his role in the infringement, and render service on him.
