Facts

Robert Sullivan was riding as a guest in a tractor trailer driven by Crabtree (defendant). Crabtree lost control of the truck, although it is not clear how, and it crashed, killing Sullivan. Crabtree testified that brake failure could have been the reason that he lost control of the truck, but he had no way of knowing for sure. Sullivan’s parents (plaintiffs) brought a negligence suit against Crabtree. The trial court ruled in favor of Crabtree. The Sullivans appealed.
