Facts
Reynolds (plaintiff) fell down a stairway operated by Texas & Pacific Railway Co. (Texas & Pacific) (defendant) while trying to catch a train. It was dark out and the stairway was not lighted and did not have a handrail. Reynolds brought suit against Texas & Pacific for negligence. The trial court ruled in favor of Reynolds.
