Facts
The Southern Metropolitan Local Council (the council) (defendant) shut off the municipal water supply to the Bon Vista Mansions. The residents of Bon Vista Mansions (the residents) (plaintiffs) tried, unsuccessfully, to go through the Bon Vista Mansions landlord to have the water supply restored. The residents then brought suit under the South African constitution, which guarantees access to water in the constitution’s Bill of Rights. The residents asked for an interim order for the council to restore the water supply while a final determination was pending.
