Facts
Richard Davis (plaintiff) sued A & E Television Networks (A & E) (defendant) for revenues allegedly owed to him for the show Flip This House. Davis claimed that he was entitled to half of the show’s revenues. Davis sought to call Mark Halloran as an expert witness on calculating damages. Halloran planned to testify that he would calculate Davis’s damages by subtracting the show’s expenses from its revenues and then dividing that difference in half. A & E filed a motion in limine to exclude Halloran’s testimony.
