Facts
A dispute arose between Germany and the United Kingdom regarding the territorial boundaries at Walfish Bay in southwest Africa. The countries agreed to arbitrate the dispute before a sole arbitrator, appointed by the king of Spain. Germany presented declarations of four witnesses favoring its position on the demarcation of the boundary, but the witnesses were not present to testify or answer questions by the arbitrator.
