Equal Employment Opportunity Commission v. Olson’s Dairy Queens

Olson’s Dairy Queens, Inc. (Olson’s) (defendant) owned a number of ice cream shops. The Equal Employment Opportunity Commission (EEOC) (plaintiff) brought suit against Olson’s. The EEOC contended that Olson’s discriminated against Blacks in violation of Title VII of the Civil Rights Act of 1964 (Title VII). The EEOC’s expert witness conducted an applicant flow analysis. The analysis revealed a statistically significant disparity between the percentage of Black applicants and the percentage of Black hires at Olson’s. The district court found that Olson’s did not violate Title VII. However, the district court completely disregarded the applicant flow analysis. The EEOC appealed.
