Definition

A special motion to strike authorized by statute to protect individuals who have engaged in constitutionally protected speech or petition activities from unfounded, strategic lawsuits against public participation (SLAPP). The motion requires plaintiffs with claims attacking constitutionally protected speech to prove a probability of success on the merits at an early stage in the litigation before being allowed to continue with the claims.
