Dual Rational Nexus Test

Definition

Test applied by courts to impact fees imposed on a subdivision, which requires the government to demonstrate a rational nexus between (1) the need for the public schools and the growth in population generated by the subdivision and (2) the expenditures of funds collected from the subdivision and the benefits accruing to the subdivision.
