Four-Factor Test
Definition
A district court has equitable discretion to grant or deny injunctive relief to a patentee for infringement of a patent if the plaintiff can demonstrate (1) that it has suffered an irreparable injury, (2) that remedies available at law are inadequate to compensate for the injury, (3) that a remedy in equity is warranted after considering the balance of hardships between the plaintiff and defendant, and (4) that the public interest would not be disserved by a permanent injunction.
