Second-look doctrine

Definition

An exception to the rule against perpetuities’ requirement that an interest created by a special or general testamentary power of appointment be measured from the date the power is created, by allowing a court to consider all of the facts known at the time of the exercise of the power when determining if the interest created violates the rule against perpetuities.
