Solem Proportionality Test

Definition

Test for assessing whether a sentence is disproportionate to the crime and therefore violates the Eighth Amendment prohibition of cruel and unusual punishment based on three objective factors: (1) the seriousness of the crime and the punishment, (2) other sentences issued within the jurisdiction, and (3) sentences issued for the offense outside the jurisdiction.
