Facts
Debra Agis (plaintiff) was employed as a waitress in a restaurant owned by the Howard Johnson Company (defendant). The restaurant manager, Roger Dionne, held a meeting in which he informed the waitstaff that theft was occurring in the restaurant but that he did not know who was responsible. Dionne told the staff that until the culprit was identified, he would fire all the servers in alphabetical order. Dionne then discharged Agis. Agis sued Howard Johnson and Dionne, seeking damages for mental anguish and emotional distress allegedly caused by her summary dismissal. The trial court dismissed Agis’s complaint, and Agis appealed.
