American Chain & Cable Co., Inc. v. Avery

Connecticut Supreme Court
143 U.S.P.Q. 126 (1964)

Facts

Avery, LeBlanc, and Pane (the employees) (defendants) worked for American Chain & Cable Company, Inc. (American) (plaintiff), a manufacturer and seller of abrasive cutting wheels. The employees left American to work for a new company, Avery Abrasives, Inc. (Avery) (defendant), which also made and sold abrasive cutting wheels. American brought a trade-secret misappropriation action, alleging that Avery had gained an unfair advantage attributable to the skills and knowledge that the employees acquired from their time at American. However, the evidence offered by American did not establish that the employees brought processes and techniques to Avery that were not generally known within the industry of abrasive cutting wheels. American also alleged misappropriation of customers’ identities and information. The case was heard by the Connecticut Supreme Court.
