Facts
Ora Anderson (plaintiff) resided on a piece of property that she owned. Anderson wanted to obtain a bank loan to remodel her house, but she did not have enough income to secure a loan. Thus, James Kimbrough (defendant), Anderson’s friend, acquired a bank loan on Anderson’s behalf. As security for the loan, Anderson executed a deed conveying her property to Kimbrough. The property was to be conveyed back to Anderson after she repaid the loan. After she executed the deed, Anderson continued to reside on the property. Yet, Anderson later defaulted on the loan payments, and Kimbrough sent a notice to Anderson to vacate the property. Consequently, Anderson filed suit, seeking to prohibit Kimbrough from evicting her. Without following foreclosure procedures, the trial court ruled that Kimbrough held title to the property. Anderson appealed.
