Anheuser-Busch Brewing Ass'n v. Mason
Minnesota Supreme Court
44 Minn. 316, 46 N.W. 558 (1890)
- Written by Josh Lee, JD
Facts
Anheuser-Busch Brewing Association (plaintiff) sold beer to Mason (defendant). Mason operated an illegal brothel, and Anheuser-Busch’s agent knew this. Mason failed to pay for the beer, and Anheuser-Busch sued her. During the trial, the agent admitted knowing that Mason operated an illegal brothel and admitted that he assumed the profits from the brothel would be used to pay for the beer. After these admissions, Mason moved to dismiss the claim. The trial court dismissed the lawsuit, and Anheuser-Busch appealed.
