Facts
Portions of the properties involved in this action were the subject of a tax foreclosure by Asotin County, the predecessor to Asotin County Port District (plaintiff). The foreclosure summons described the parcels as “part of Lot 5, Section 17, Township 11 N.R. 46 E.W.M.,” and the subsequent action to quiet title described them as “Acres in Lot 5 . . . .” Asotin County Port District brought suit to quiet title to the subject parcels and reform a deed given by Lewiston-Clarkston Improvement Company, Clarkston Community Corporation’s (defendant) predecessor, to Asotin County. The trial court found in favor of Clarkston Community Corp. Asotin County appealed.
