Facts
Mrs. J. H. W. Behrens (plaintiff) was a circus performer. Bertram Mills Circus, Ltd. (Bertram) (defendant) granted Whitehead, Behrens’s manager, a license to have Behrens and her husband work at Bertram’s circus. Bertram forbade the presence of dogs at its circus. Nonetheless, Whitehead brought his dog to the circus and the dog barked at one of Bertram’s trained elephants, causing the elephant to chase after the dog. During the chase, the elephant injured Behrens and damaged her booth. The Behrenses brought suit.
