Facts
Ronald Bierczynski (defendant) was engaged in a drag race with Robert Race when Race lost control of his car and crashed into the Rogerses (plaintiffs). The Rogerses brought suit against both Bierczynski and Race for negligence. The trial court found Bierczynski and Race jointly liable. Bierczynski appealed.
