Facts
Bobbs-Merrill Company (Bobbs) (plaintiff) owned the copyright to a book entitled The Castaway. Bobbs had a notice requiring a sale price of at least $1, which was printed directly below the copyright notice. Isidor and Nathan Straus (defendants) purchased copies of The Castaway for retail sale at R.H. Macy & Company (Macy) (defendant). Macy sold the copies of The Castaway for $0.89 per book. Bobbs filed suit, seeking an injunction against the sale of copies of the book for less than $1. The circuit court dismissed the suit, and Bobbs appealed.
