Facts

The City of Detroit (defendant) proposed to build an outdoor swimming pool in Palmer Park, which was near various apartments and properties owned by several parties (collectively, property owners) (plaintiffs). The city council held a public meeting on the site of the pool, and in response to the property owners’ complaints about noise, traffic, and parking issues that would arise from the pool’s operation, the city council selected a new location for the pool over 400 feet away from the nearest apartment. The property owners nevertheless sued the city, praying for an injunction to stop the pool construction at the new location because it would constitute a nuisance. The trial court granted summary judgment for the city. The property owners appealed.
