Facts
A Texas sheriff (defendant) offered a $500 reward to anyone who captured and brought in an escaped prisoner. The plaintiff captured and brought in the prisoner, but the sheriff refused to pay the reward. Suit was brought, to which the sheriff filed demurrers on the grounds that the plaintiff did not allege having notice or knowledge of the reward at the time of the prisoner’s capture and return. The trial court agreed and dismissed the case. On appeal, the Court of Civil Appeals of the Third Supreme Judicial Circuit certified the present issue to the Supreme Court of Texas.
