Facts
When Nicole Brodeur was a 15-year-old sophomore in the Claremont School District (district) (defendant), her biology teacher, Gene Grumman (defendant), made several comments in class about her buttocks. As an example, Grumman commented on the size of Brodeur’s hips and said that if her parents fed her less “maybe that would help.” In another comment, Grumman stated that if Brodeur were to walk down the hallway, she would knock over all the lockers due to the size of her buttocks. In yet another example, Grumman told another student to make a circle bigger on the chalkboard by saying, “Make it as big as Nicole’s butt.” Brodeur and her parents (plaintiffs) sued the district and Grumman for multiple claims, including intentional infliction of emotional distress.
