Jeff Burgar (defendant) registered the website brucespringsteen.com. When Internet users entered brucespringsteen.com, they would be redirected to Burgar’s own site about celebrities. As part of the domain-name registration process, Burgar agreed to the Uniform Domain Name Dispute Resolution Policy (UDRP). Under the UDRP, Burgar agreed that if anyone claimed there was a problem with the domain name, Burgar would submit to administrative proceedings before a private panel of experts in domain-name law. Bruce Springsteen (plaintiff) owned and operated brucespringsteen.net. Springsteen submitted a claim under the UDRP, arguing that Burgar’s use of the domain name brucespringsteen.com violated Springsteen’s common law right to his own name.
