Bryant v. Tri-County Electric Membership Corp.
United States District Court for the Western District of Kentucky
844 F. Supp. 347 (1994)
- Written by Sean Carroll, JD
Facts
An electric switch in the Bryants’ (plaintiffs) sawmill exploded, starting a fire that caused the sawmill to burn to the ground. Tri-County Electric Membership Corporation (Tri-County) (defendant) supplied the electricity to the sawmill. The Bryants brought a products-liability suit against Tri-County based on strict liability. Tri-County moved to dismiss, arguing that Tri-County could not be strictly liable for the sale of electricity.
