Facts

Cabrini-Green was a public-housing development in Chicago that offered subsidized rental units to low-income families. Ninety-four percent of the heads of households at Cabrini-Green were African-American. Cabrini-Green was managed by the Chicago Housing Authority (housing authority) (defendant). The housing authority drafted a plan for the redevelopment of Cabrini-Green. The plan provided for the demolition of several buildings, which would displace 675 families. Further, the plan stated that only 300–325 replacement units would be built. Thus, over 300 Cabrini-Green families, the majority of whom were African-American, would be denied replacement housing. The Cabrini-Green Local Advisory Council (council) (plaintiff), a tenant organization representing the tenants of Cabrini-Green, brought suit against the housing authority. The council asserted a variety of claims, including claims alleging that the plan was racially discriminatory in violation of the Fair Housing Act (FHA) and Title VI of the Civil Rights Act of 1964 (Title VI). The housing authority filed a motion to dismiss. The district court took the motion under advisement.
