Facts
A student (plaintiff) at California State University, Fullerton (university) (defendant) lived with a visual impairment. The student could not read printed text to obtain information, instead using a computer program that converted text into auditory language. The student registered with the university’s Disabled Student Services (DSS) and followed DSS’s procedures to obtain auditory materials for her registered classes. Although the student followed the procedures, DSS repeatedly failed to send her electronic versions of the materials until well after classes had begun. These delays forced the student to withdraw from the classes and retake them. The student submitted a complaint to the Office of Civil Rights (OCR), which investigated the matter. The OCR interviewed DSS staff, who explained that limited resources caused the delays. During the investigation, the university provided the OCR with a resolution agreement that committed to providing additional resources to the DSS to ensure timely conversion of class materials to alternative formats for students with disabilities.
