Facts
John and Sue Maddox (defendants) orally agreed to sell certain property to Morris and Betty Cash (plaintiffs). The Cashes mailed a check to the Maddoxes for $200 as partial payment. The check stated: “15 acres in Pickens, S.C.” There was no other writing establishing the agreement. The Maddoxes cashed the check but subsequently decided they did not want to sell the property. The Cashes brought suit seeking specific performance of the purported contract. The trial court found a valid contract and ruled in favor of the Cashes. The Maddoxes appealed, arguing that the purported contract did not satisfy the statute of frauds.
