Facts

Chesler (plaintiff) was the author of the book Woman and Madness. The book was first published in hardcover form, but the original publisher later entered into an agreement with Avon Book Division (defendant) pursuant to which it granted Avon the right to publish the book in paperback form. Following publication of the paperback edition, Chesler brought suit against Avon for tortious conduct, including unfaithful and negligent reproduction of her work, and libel, among other causes of action. Chesler claimed the paperback edition was not a faithful reproduction of her work, asserting that relevant portions of the text, illustrations, and footnotes were either omitted, altered, or rearranged in such a manner that amounted to a mutilation of her work and harm to her reputation as an author.
