Facts
Clark (plaintiff) underwent surgery at St. Thomas Hospital (defendant). Prior to his release, Clark fell during an x-ray procedure. Clark sued the hospital for damages, alleging his fall was caused by the x-ray technician's negligence. At trial, the hospital introduced a videotape as evidence. The tape showed a reenactment of the x-ray procedure as the technician testified the procedure was conducted. The jury entered judgment for the hospital. Clark appealed to the Court of Appeals of Tennessee arguing the tape was inadmissible as evidence.
