Twin Rivers had a large residential and commercial community with a population of approximately 10,000 residents. The Twin Rivers Homeowners’ Association (the association) (defendant) served as the governing body that maintained public spaces in Twin Rivers and administered and enforced the many restrictive covenants that governed the operation of the community. These covenants included restrictions that limited the location, size, and number of signs that homeowners may install on their own property within Twin Rivers. A group of Twin River residents formed a committee, the Committee for a Better Twin Rivers (the residents) (plaintiffs) and brought a multiple-count complaint against the association. The primary complaint sought to invalidate the association’s sign policy. The lower court granted the association’s motion for summary judgment. The residents appealed, and the appellate-division court reversed the trial court, holding that the association’s restrictions were subject to state constitutional standards, and remanded the case. The New Jersey Supreme Court granted the association’s motion for certiorari.
