Facts
Walter Burr (defendant), a general contractor, was awarded a project by the General Motors Corporation (GM) to construct a central air-conditioning plant at a GM facility near Mesa, Arizona. As part of the process, Burr had solicited bids from subcontractors, including Corbin-Dykes Electric Company (CDE) (plaintiff). Although Burr incorporated CDE’s winning bid in its proposal to GM, Burr chose a different subcontractor after GM awarded him the contract. CDE objected and filed suit against Burr for breach of the purported subcontract. The trial court granted Burr’s motion for summary judgment. CDE appealed.
