Anne-Marie Couderc (plaintiff) was the publication director of the magazine Paris Match. Hachette Filipacchi Associés (Hachette) (plaintiff) was the magazine’s publisher. An article in the Daily Mail stated that Paris Match was going to publish an article detailing an interview with Ms. Coste, who claimed to be the mother of the only son of Prince Albert Grimaldi of Monaco. Prince Albert instructed Couderc not to publish the article, but the article was published. The article detailed Coste’s account of a relationship with Prince Albert, including how the prince reacted to the pregnancy and the child and how he interacted with Coste thereafter. The article included five pictures of Prince Albert with the child and three pictures of the prince with Coste. A French domestic court found that the publication improperly interfered with the prince’s private life. Hachette and Couderc filed an application with the European Court of Human Rights asserting that the ruling violated Article 10 of the European Convention on Human Rights (convention).
