Facts
Nineteen year old Daniels, (plaintiff) decedent, was killed when his motorcycle collided with Evans’ (defendant) automobile. The Daniels’ family brought suit against Evans for negligence, and the jury also considered the comparative negligence of the Daniels’ decedent. After the trial court instructed the jury that it should evaluate the Daniels’ decedent’s comparative negligence according to a minor child standard of care, the jury returned a verdict for Daniels. Evans appealed.
