Facts
DiLiddo (plaintiff) was disabled and qualified for a subsidized temporary housing program for people with disabilities. Massachusetts law provided that landlords may not discriminate against tenants who receive one of these subsidies either because the tenant is a recipient or because of one of the requirements of the subsidy program. DiLiddo expressed interest in renting an apartment from Oxford Street Realty (Oxford) (defendant). Oxford agreed to rent her the apartment at first, but soon changed its mind after reading the form lease provisions that came as part of the subsidy program. Specifically, Oxford objected to an early termination clause in the lease allowing DiLiddo to terminate the lease with only one month’s notice.
