Facts
Donald B. (plaintiff) was a healthy six-year-old with a speech disability who attended a private school. The Board of School Commissioners of Mobile County (the district) (defendant) created an individual education plan that provided Donald with speech therapy at a public school three blocks away from the school Donald attended. Donald and his mother (plaintiff) requested that the district provide transportation for Donald between the two schools. The district declined to provide transportation, and Donald’s mother filed an administrative appeal of that decision. After the appeal was denied, Donald’s mother filed a claim in federal district court, alleging that the district’s denial of transportation violated the Individuals with Disabilities Education Act (IDEA). The district court held that the district had no obligation under the IDEA to provide the requested transportation. Donald’s mother appealed.
