E.E. v. O.M.G.R.
New Jersey Superior Court
20 A.3d 1171 (2011)
- Written by Liz Nakamura, JD
Facts
E.E. (plaintiff), a single woman, entered a contract with her friend, O.M.G.R. (defendant), pursuant to which O.M.G.R. would donate his sperm to E.E. so that E.E. could conceive a child via artificial insemination. In the contract, O.M.G.R. voluntarily waived all parental rights to the resulting child. E.E. and O.M.G.R. did not involve a licensed physician at any stage of the process, and E.E. handled the artificial insemination herself. When the child, G.J.E., was born, no father was listed on the birth certificate and the parties signed a consent order stating that O.M.G.R. had voluntarily relinquished his parental rights to G.J.E. and that E.E. had assumed all rights and responsibilities for G.J.E.’s wellbeing and support. The consent order was submitted to the superior court, and E.E. moved to terminate O.M.G.R.’s parental rights and to have sole custody of G.J.E. with no visitation from O.M.G.R.
