Facts

During a labor dispute, off-duty employees (the employees) (plaintiffs) of F.W. Woolworth Co. (Woolworth) (defendant) were stationed outside the store entrances giving handbills to potential customers and trying to convince them to shop elsewhere. The employees were not blocking the doors and moved to the side when requested by a district manager. Woolworth did not accuse the employees of any misconduct other than standing near the outside of the store’s doors. Woolworth photographed and videotaped the employees in this act. The union filed a charge against Woolworth, and at the administrative hearing, the administrative-law judge found Woolworth had violated § 8(a)(1) of the National Labor Relations Act for photographing and videotaping the employees. Woolworth sought review by the National Labor Relations Board (NLRB) of the judge’s findings.
