Facts
Mindy Floyd, a minor child, was injured by a lighter manufactured by Bic Corporation (Bic) (defendant). Floyd’s parents (plaintiffs) brought a claim on Floyd’s behalf, alleging that she had been injured by the defective or negligent design of Bic’s lighter. Among other claims, Floyd argued that Bic had a duty to design a childproof lighter because lighters could be dangerous when used by children. Bic moved for summary judgment on the issue.
