Facts
Winn-Dixie Stores, Inc. (Winn-Dixie) (defendant) operated a chain of grocery and pharmacy stores. Through Winn-Dixie’s website, consumers could fill and refill prescriptions for in-store pickup or delivery, locate physical stores, and learn about Winn-Dixie brand items and product recalls. Juan Carlos Gil (plaintiff), a legally blind person, was unable to access Winn-Dixie’s website because it was incompatible with his screen-reader software. Gil sued Winn-Dixie in federal district court, alleging that Winn-Dixie had violated Title III of the Americans with Disabilities Act (ADA) by failing to make its website accessible to people with visual impairments. Winn-Dixie filed a motion for judgment on the pleadings, arguing that websites are not subject to Title III of the ADA. The district court considered Winn-Dixie’s motion.
